[Column] Beyond the mosaic
🕑 Added 2024-02-16 08:44:45 +0000 UTCIt’s getting long, so I will post in English and Japanese separately.
------------------------------------
------------------------------------
I had a dream that Patreon banned AI-generated works.
It was quite real and scary because I had been thinking that it was only a matter of time.
So, let me write a column related to my activities. It’s about ‘mosaic processing’. This is a story related to the act of creating pornography works while living in Japan.
------------------------------------
There are two aims for this column,
One, I want to share information with patrons who are looking from outside Japan. So it will be quite long.
One, to conclude, there might come a time when uncensored things will no longer be published.
Oh, and one more thing, I recommend that you get out what you're going to get out first before you read it, before you come to see something erotic and then your dick goes soft because of a hard story.
One more thing, although persistent, is that the text in this column was written by a layman who is not an expert in anything, so there is no denying the possibility that it is all wrong, so I would appreciate it if you read it only as a reference.
------------------------------------
In all, there are over 12,000 characters.
I think I will discuss in three items.
Chapter 1 : The difference in mosaic processing between Japan and other countries
Chapter 2 : Public roads where the speed limit depends on the mood
Chapter 3 : If it is made in Japan, it doesn’t matter whether you live overseas or not.
------------------------------------
Chapter 1 : The difference in mosaic processing between Japan and other countries
Speaking only of Japan, mosaic processing is notably performed mainly on acts related to pornography.
It can also be applied to items of companies that are not sponsors, or to the background of a sponsor logo. This is also the case in other countries.
This is a story I heard, not something I saw, but there is a channel that claims to be a public broadcast called NHK that does not mention company names or character names, and in the past, it seems that there was a case where when buying juice from a vending machine in a drama, it was wrapped in duct tape to make it unrecognizable.
The story has deviated, but the reason why mosaic processing is done in Japan is because
“there is NO obscene material in Japan”.
Under Japanese law, images and videos that expose the ‘genitals’ are subject to punishment as obscene materials. It may be applied to gore expressions, but that is self-regulation considering people who are not good at it, so even if there are people who feel sexual excitement about it, it has nothing to do with this case.
Also, anus is not subject to mosaic. This is because there is a pretext that the anus is an excretory organ and not a sexual organ. In a broad sense, it is the same as not applying a mosaic to the mouth, but in recent years, there seems to be a lawyer who says ‘the anus is included in the sexual organs’. They are enemies.
‘What? I’ve seen an AV with a mosaic on anus? Isn’t it applied when inserting a finger or pushing a pearl?’ You might have thought, but actually, that is self-regulation of the industry. This story will be involved in Chapter 2.
In Japan, the obscene material is mosaicked to comply with the law (Chapter 22, Article 175 of the Penal Code, the crime of distribution of obscene material), and has evolved in a unique way not seen in other countries.
You may be thinking, "Even so, there's a penis and a pussy there, and they're even inserting it, or sucking it, right?"
A few years ago, there was an incident in which a large amount of data from adult videos before mosaic processing was leaked. And porn fans around the world were aghast at the contents. In fact, there were almost none of them that showed actual penetration, sucking or licking of real dicks.
What I thought I was sucking was actually my thumb. What I thought I was inserting was actually a dildo made to look like one. I thought I had removed a condom and had a cum inside, but I was wearing a condom with a color that looked like I had removed the condom. Some people said, "It's like a scam".
However, it is premature to think it is a scam. The fact that the mosaic in the above example was made to look like such an act is one of craftsmanship. It is also a way to avoid the burdens inherent in pornography for male actresses and to make it look that way, which leads to continuity and quality in the work. This is what I described above as a "unique evolution" in terms of stable supply, and the production that can be expressed by the presence of mosaic.
In other words, pornography in Japan and pornography in other countries are not similar.
------------------------------------
Chapter 2 : Public roads where the speed limit depends on the mood
Even so, Japan’s porn works often become a problem. One of the most recent and notorious ones is the ‘AV New Law’ that was newly established in 2022 and had some movement on February 10th this year.
However, since it has nothing to do with mosaics, I will put it aside as a separate story (although it is slightly involved in the case where someone was arrested in December 2022). The related one is the infamous ‘Tokyo 2020 Olympics’ held in 2021.
You might wonder what the Olympics have to do with mosaics, but this is not about the Olympics itself, but about the fact that ‘the eyes of the world are on Japan’.
This is where the part titled ‘speed limit depends on the mood’ in this chapter comes into play.
It is often said that Japan is more tolerant than other countries in terms of sexual expression, but what happens when the eyes of other countries, which are thought to be not tolerant, enter the current situation? From such concerns, movements such as the size of mosaics and legal revisions become active at such timings.
In fact, there is no clear standard (not explicitly stated) for how many pixels of mosaic is good, or whether you really need anus itself and if you push it in.
You could be caught for speeding all of a sudden even though you were driving at 50kph (about 31mph) on a daily basis.
“So how many kilometers can I drive without getting caught?”
“Please be careful next time.”
“How many kilometers?”
“You shouldn’t drive dangerously.”
There will probably never be a standard shown.
In law, obscenity is, quoting from the Supreme Court precedent known as the ‘Chatterley Case’,
＿＿＿＿＿＿＿＿＿＿＿＿＿＿
Something that harms the shame of ordinary people
Something that excites, stimulates sexual desire
Something that goes against good sexual moral sense
￣￣￣￣￣￣￣￣￣￣￣￣￣￣
and here too, no clear standard is shown.
The ‘Shobunkan Trial’ that used this precedent was ruled obscene in 2007, but looking at the course of events, it seems that it was only seen as a problem due to the ‘mood of the authorities’.
I will take the Shobunkan trial as an example, but why was it judged as obscene?
It is simply because of the ‘thinness of the correction’. (There could be a high level of realism)
The thinness of the corrections in adult comics at that time (depending on the publisher) was such that it was more like adding accessories rather than making corrections, and when reproduced, it was something like this.
In a highly realistic work, it was like this, and in a work with a high deformation component, it was like this.
Because it might be judged as chxxd pornography if it is deformed, I make it look like that.
You wouldn’t notice that it’s corrected unless you pay attention.
And actually, I have read the work that became the point of contention in the Shobunkan trial for some reason. The correction method of that work is like this.
It was a correction wrapped in oblate, and I could clearly see genitals. It really looks like it’s wearing a veil with accessories. I prefer this one.
However, in fact, this correction method is still used in live-action. It’s not AV, but what is called an image video (IV), and because the shooting is done to make it hard to understand by drastically reducing the brightness, when you watch it and raise the brightness on the software side, you can see uncensored things. Of course, the performers are adults, so it’s a hard-to-understand effort from countries without mosaics.
After all, even from the works of that time, there is no doubt that the correction was thin, but it is questionable whether only the work in question was specially ‘obscene’. In fact, at that time, it was common to have no corrections for penis and dubious corrections for vagina, which were about two lines.
Like a certain Mr. JKP at that time.
That trial is said to have been ‘made an example of’, but honestly, that was the most convincing thing.
Since then, the correction of adult-oriented works in Japan has become denser as follows. By the way, the works distributed at events like comike were originally dense.
By the way, cross-sectional diagrams and uterine cervix such as internal organs are sometimes not mosaic processed. The popularity of cross-sectional diagram expressions may also have this background.
Also, on support sites such as FANBOX and FANTIA, the corrections are still thin.
------------------------------------
Chapter 3 : If it is made in Japan, it doesn’t matter whether you live overseas or not.
In other words, as long as it is properly corrected and it is not clear whether there really is genitals there, there is no problem. But what about those that are posted on servers overseas? That’s what my activities are like.
I don’t know about foreign trials, but in Japan, it is a ‘precedent principle’ with many ‘super’. Judgments are made based on past precedents in similar cases. So, is there a case in the past that could be judged similar to my activities? There is.
That is the ‘Caribbeancom’ case.
Totally unrelated pirate costume.
Caribbeancom is an uncensored AV manufacturer that places servers overseas and features Japanese AV actresses. It’s a manufacturer that sells uncensored legally because it’s an overseas server. It is still in business, but it was cracked down in 2017.
First of all, Japanese criminal law applies to criminal acts committed within the territory, regardless of the nationality of the offender. This is called ‘territoriality’, and even if it is part of a criminal act, if the result of the crime occurs within Japan, it is punished as a domestic crime. It is thought that this also applies to the person who was said to be the director in the Philippines in a series of incidents commonly named the ‘Luffy Wide Area Robbery Incident’, who was repatriated to Japan.
In the case of Caribbeancom, the point is that ‘obscene materials made in Japan were uploaded to a server overseas’. I think the same wording would be used to summarize my activities.
Until a certain period, indeed, the way Caribbeancom did things was legal, or could be called a loophole, and was outside the application of criminal law. However, the situation changed completely with the revision of the Criminal Code in 2011. One of the sentences in it says,
‘Those who distribute obscene electromagnetic records or other records by transmitting telecommunications shall also be treated the same.’
And the Supreme Court interpreted the meaning of this ‘distribution’ as ‘causing an unspecified number of people’s computers to record obscene information via the Internet.’ As a result, the crime of ‘distribution’ occurred in Japan, and it seems to have been judged that the application of Japanese criminal law is possible as a domestic crime.
Well, there are various opinions that there is a problem with this way of thinking, but as I said in the previous chapter,
‘You never know when the authorities will make that judgment based on their mood.’
That’s the part I want to share in this column.
------------------------------------
・in conclusion
I have always lived in the countryside where public transportation is scarce, so I can’t do without a car.
I drive almost every day and have had no accidents or violations since I got my license. I basically obey the speed limit and don’t start moving just before the signal changes. The reason for this is not so much that I want to be a good boy, but that I don’t want to be at a disadvantage.
When the police saw my actions, could I be stopped? Could I do it with confidence? Naturally, that’s how it turned out.
So, in fact, isn’t the act of posting uncensored images here quite dangerous?
As far as I know, I have never heard of a person living in Japan being caught uploading uncensored images on Patreon, and if anyone were to be caught, I think it would be someone who has been active longer and has more views than me, but I wonder if it’s true that I’m doing quite a disadvantageous activity.
I’m sorry for the serious content, but basically, the creation scene is like the one below.
I want to continue creating works that turn my penis into fully erect and everyone else’s penis into fully erect.
