Except Nintendo would just buy the judge ~. Or threaten the Judge that the Judges Gavel is too similar to the Hammers used by the Hammer Bro's.

1000% accurate. Nintendo is largely owned and run by extremely terrible people.

I know it won't happen, but I would love for Nintendo to get dragged to court over it. Emulators are legal and any judge worth their salt would stomp Nintendo for this abuse of the DMCA. But it'd cost way too much time, money, and stress for the wrongfully claimed to fight it, so again, it won't happen.
